TERMS AND CONDITIONS

These Terms and Conditions govern your use of this website and the purchase of products from Tintinara CC t/a 4Ren6 ("we", "us", or "the Company"). By placing an order, you confirm that you have read, understood and agree to be bound by these Terms and Conditions in their entirety. Please read them carefully before purchasing.

 

1. Company Details

This website is operated by Tintinara CC t/a 4Ren6, a business registered in the Republic of South Africa under registration number 1986/016527/23.

2. Nature of Products and Intended Use

We retail the following categories of products (collectively, the "Products"):

  • Vape detection sensors and associated accessories;

  • Alcohol oral (saliva) test kits;

  • Cotinine (nicotine/vape) oral (saliva) test kits; and

  • THC (tetrahydrocannabinol / cannabis) oral (saliva) test kits.

 

All Products are sold strictly for lawful purposes only, including but not limited to personal health monitoring, occupational health and safety screening, workplace drug and alcohol testing policies, educational purposes and parental monitoring.

By purchasing any Product, you warrant and represent that:

  • You are 18 years of age or older;

  • You will use the Products only for lawful purposes in compliance with all applicable South African laws and regulations, including the Occupational Health and Safety Act 85 of 1993, the National Road Traffic Act 93 of 1996 and any applicable workplace policies;

  • You will not use the Products to facilitate any unlawful activity;

  • You understand that our test kits are screening tools only and do not constitute conclusive medical or forensic evidence. Results should be confirmed by a certified laboratory where required for legal, disciplinary or medical purposes.

 

We reserve the right to refuse any order where we have reasonable grounds to believe the Products will be used unlawfully.

 

3. Age Restriction

Our Products, in particular vape detection sensors and cotinine test kits, are intended for use in the context of monitoring and testing. The purchase of all Products on this website is restricted to persons who are eighteen (18) years of age or older. By placing an order, you confirm that you meet this age requirement. We reserve the right to request proof of age and to cancel any order where we cannot verify the purchaser's age.

 

4. Agreement of Sale

An agreement of sale between Tintinara CC t/a 4Ren6 and a customer only comes into effect once:

  • Electronic payment has been successfully processed and the funds have cleared in our bank account; and

  • The order has been confirmed and dispatched.

 

We reserve the right to cancel any order at any time and for any reason, including but not limited to stock unavailability, pricing errors or concerns regarding the intended use of Products. In the event of cancellation, a full refund will be issued to the original payment method within fourteen (14) business days.

 

5. Pricing and Availability

All prices displayed on our website are in South African Rand (ZAR) and include VAT. Prices are subject to change without prior notice.

While we strive for complete accuracy, if a Product is inadvertently listed at an incorrect price due to a system error or typographical mistake, we are not bound to supply the Product at that incorrect price. We will notify you of the error as soon as possible and offer you the option to purchase at the correct price or receive a full refund.

Product availability is not guaranteed. We will notify you promptly if a Product you have ordered is out of stock and will offer you a backorder, substitute or full refund.

 

6. Delivery and Risk

We deliver across South Africa using third-party courier services. The following terms apply to delivery:

  • Risk in the Products passes to you upon delivery to your specified shipping address;

  • Estimated delivery times are provided as a guide only and are not guaranteed;

  • We are not liable for delays caused by third-party courier services, force majeure events, or incorrect delivery addresses provided by you;

  • If an item is lost or damaged in transit, please contact us within forty eight (48) hours of the scheduled delivery date so we can initiate a claim with the courier and arrange a replacement or refund;

  • Deliveries can only be made to a physical address and all deliveries need to be physically received and receipt is to be signed for by the recipient.  

 

7. Disclaimer of Liability – Product Results

Our test kits (alcohol, cotinine/nicotine, and THC/cannabis) are screening tools intended for preliminary indication purposes only. We make the following important disclaimers:

  • Test results may be affected by individual physiological factors, the manner of use, storage conditions and the timing of the test relative to substance exposure;

  • Our Products are not registered medical devices and are not intended to diagnose, treat, cure or prevent any medical condition;

  • Positive or negative results from our Products should not be relied upon as conclusive evidence in legal, disciplinary, insurance or medical proceedings. Confirmatory laboratory testing by an accredited facility is required for such purposes;

  • We accept no liability for any decisions made, actions taken or consequences arising from the use of or reliance upon the results of our Products;

  • All drug and alcohol testing programmes must be conducted in compliance with the applicable laws and workplace / institution policies and should be implemented with the guidance of a qualified occupational health practitioner.

 

8. Intellectual Property

All content on this website, including but not limited to text, images, logos, product descriptions, and software, is the intellectual property of Tintinara CC t/a 4Ren6 or its licensors and is protected under the Copyright Act 98 of 1978. You may not reproduce, distribute or use any content from this website without our prior written consent.

 

9. Limitation of Liability

To the maximum extent permitted by applicable South African law, including the Consumer Protection Act 68 of 2008 ("CPA"), we shall not be liable for any indirect, special, incidental, consequential or punitive damages arising from your use of our Products or website. Our liability to you shall in no event exceed the purchase price paid by you for the relevant Product.

 

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the South African courts.

 

11. Amendments

We reserve the right to amend these Terms and Conditions at any time. Updated Terms will be posted on our website with the date of the most recent revision. Continued use of our website or placement of orders following any amendment constitutes your acceptance of the revised Terms.
